Environment and Natural Resources Law Enforcement

The environmental challenges facing individuals, communities, private companies and governments throughout the world are numerous and complex. Most governments, companies and civil society organisations now recognise that environmental issues are intertwined with social, cultural and economic issues. Promoting economic growth with environmental, human health and cultural safeguards in place seems to be the path forward for most governments, but decades of environmental mismanagement have created severe legacy issues in most countries.

Two huge challenges are determining how to clean up legacy problems, restore natural resources, and achieve human health protection and health ecosystems; and designing strategies to enable future growth while protecting the environment, maintaining biodiversity, safeguarding human health, and preserving cultural and social values. This results in a very complex set of decisions for government at all levels, and a regulatory framework that is supportive, facilitating and enabling is essential.

Many of these problems and issues traverse national and other administrative boundaries, and many of the natural resources affected are examples of a global commons. Such transboundary challenges highlight the need for decision-making processes, management agreements and procedures for dispute resolution that go beyond the borders of individual nation states.

They illustrate the necessity of creating administrative and legal structures capable of enabling ecologically sustainable and socially acceptable development.

Relate the discussion above to your personal experiences, and note down any examples you are aware of. Firstly, do you know of any examples in your region where government failed to implement environmental protection measures required by international environmental agreements because of local protest or objection?

Secondly, are you aware of any environmental projects in your region funded by government, donor states or international institutions?

Natural Resource Governance Framework

Environmental law describes a network of regulations and customary laws that address the effects of human activity on the natural environment. These laws are also referred to as environmental and natural resource law and center on the idea of environmental pollution. In addition to this issue, environmental law works to manage specific natural resources and environmental impact assessment. There are a few key areas that environmental law works to regulate in order to lessen the impact on the environment. Some of these areas include:. As you can see from the list above, environmental laws play a huge part in protecting humans, animals, resources, and habitats.

Natural Resource Governance Framework

Start date. Natural Resources form the bedrock of global economic development. However, development and use of natural resources have implications for the environment, often leading to other socio-economic and political challenges such as poverty, disease and conflicts, especially in developing countries. The resulting environmental impacts such as climate change, pollution and degradation of habitats and species extinction has also raised serious challenges for governance and diplomacy at the international level, often pitting international economic policies and frameworks with natural resources and environmental governance. This course will provide you with an excellent understanding of the law and policy issues in this area, and skills necessary to pursue a career in this exciting field, whether this be in private legal practice, as in-house lawyers in corporations, policy-oriented work in intergovernmental and other international institutions in advocacy in civil society organisations.

Natural Resources and Environmental Law and Policy

The effectiveness and equity of governance processes critically determine both the extent to which ecosystems contribute to human well being and the long-term prospects for successful conservation of nature. Securing rights and sharing power and responsibilities through strengthened natural resource governance benefits both people and biodiversity. Thus, governance is a necessary foundation for a just world that values and conserves nature and contributes to the achievement of global sustainable development goals.
